삼성의 OLED(유기발광다이오드) 기술을 LG로 빼돌린 혐의로 재판에 넘겨진 전 삼성디스플레이 수석연구원이 징역형을 확정받았다.

대법원 1부(주심 이기택 대법관)는 산업기술의 유출방지 및 보호에 관한 법률 위반 등 혐의로 기소된 연구원 조모(54) 씨의 상고심에서 징역 8개월에 집행유예 2년을 선고한 원심판결을 확정했다고 22일 밝혔다.
함께 재판에 넘겨진 LG디스플레이와 협력업체는 무죄가 확정됐다.
조 씨는 2011년 5월부터 이듬해 1월까지 삼성디스플레이 설비개발 팀장 시절 획득한 OLED 패널 대형화의 핵심기술 정보를 수 차례에 걸쳐 유출한 혐의로 기소됐다.
1심은 "영업비밀 보호서약에도 중요자료를 폐기하지 않고, 퇴사 후 자료를 받아 문건을 만들어 LG에 전달했다"면서 "해당 자료는 삼성이 업계 최초 출시를 목표로 한 올레드 패널 관련으로, 매우 민감하게 반응할 기술정보였다"며 징역 1년에 집행유예 2년을 선고했다.
2심은 조 씨가 삼성 측과 합의한 점을 참작해 징역 8개월에 집행유예 2년으로 일부 감형했다. 대법원도 원심에 잘못이 없다며 판단을 유지했다.
